Terms of Service for electronically supplied services
Effective from: 4 June 2026 · Wersja polska
This is a translation. In case of any discrepancy, the Polish version prevails.
These Terms set out the rules for using the BitliView service (the “Service”), supplied electronically in accordance with the Polish Act of 18 July 2002 on providing services by electronic means.
§1. General provisions
- Service Provider — Seweryn Rogut, contact: [email protected].
- User — a person or entity using the Service through an account.
- Organisation — a parent account grouping users and projects.
- Content — files and data uploaded by the User (point clouds, 360° panoramas, orthomosaics, descriptions).
§2. Scope of services
The Service enables hosting and sharing 3D point clouds, 360° panoramas, orthomosaics and virtual tours in the browser, including generating public preview links and embedding viewers. The scope may expand over time.
§3. Account and conclusion of the agreement
- Access is by invitation (invite-only). A working e-mail address is required.
- The agreement is concluded when the account is activated (setting the password from the invitation).
- The User is responsible for keeping the password confidential and for actions performed on their account.
- The User must provide true information and keep their e-mail address up to date.
§4. Technical requirements
Using the Service requires a modern browser with WebGL/JavaScript support, an internet connection and an active e-mail address. Performance of the 3D viewer depends on the device hardware and graphics card.
§5. Rules of use (prohibitions)
In particular, it is prohibited to:
- upload unlawful content or content infringing third-party rights (including copyright),
- publish personal data of third parties without a legal basis,
- distribute malware or spam, or take actions that disrupt the Service,
- attempt to bypass security measures or gain unauthorised access to other organisations’ data.
§6. User content and liability
- The User retains the rights to the uploaded Content.
- The User grants the Service Provider a non-exclusive licence to the extent necessary to provide the service (storage, technical processing, display in the viewer).
- The User represents that they hold the rights to the uploaded Content and a legal basis for processing any personal data it contains (e.g. images of people in panoramas). In this respect the User is the data controller and the Service Provider is the processor (Art. 28 GDPR) — details in the Privacy Policy.
- The Service Provider is not responsible for User Content but may remove unlawful content after receiving credible information about it.
§7. Payments (early access)
During early access the Service is free of charge. Any paid plans will be introduced in the future under a separate price list and terms, with prior notice and with the User’s consent. Consumer-rights provisions (including the 14-day right of withdrawal) will apply only to future paid agreements with consumers.
§8. Availability and liability
The Service Provider makes every effort to ensure continuity of operation but does not guarantee uninterrupted availability — technical and maintenance breaks may occur. The Service Provider’s liability is limited to the extent permitted by law; Users are advised to keep their own backups of the Content.
§9. Complaints
Complaints may be sent to [email protected]. A complaint should include a description of the problem and contact details. Complaints are handled within 30 days.
§10. Termination
The User may stop using the service at any time and request deletion of the account. The Service Provider may terminate the agreement in the event of a material breach of these Terms, after a prior request to remedy it where circumstances allow.
§11. Personal data
The rules for processing personal data are described in the Privacy Policy.
§12. Changes to the Terms
The Service Provider may change these Terms for important reasons (changes in law or in the scope of services). Users will be informed of changes in the Service or by e-mail.
§13. Final provisions
Matters not covered by these Terms are governed by Polish law. Jurisdiction is determined in accordance with generally applicable law (including the Polish Code of Civil Procedure); in disputes with consumers, consumer-protection provisions apply. A consumer may use out-of-court dispute resolution methods, including the European Commission’s ODR platform.
